A fresh controversy has erupted the delayed official recognition of Sovandeb Chattopadhyay as the Leader of the Opposition. Despite being publicly designated for the high-profile post by the TMC leadership following the recent assembly elections, Chattopadhyay has not yet been formally allocated his designated chamber or seat in the House, leaving the Leader of the Opposition's office locked.
Replying to a RTI query, Assembly Secretary Soumendranath Das stated that the Trinamool Congress failed to comply with mandatory statutory rules and parliamentary conventions while submitting their leadership nominations. Das revealed that the official application forwarded by the party lacked a formal 'resolution copy' or signed letters of support from the elected legislators. Consequently, the assembly authorities were left without any legally binding written proof or specific enumeration detailing how many sitting TMC MLAs explicitly back Chattopadhyay's appointment as the leader of the legislative opposition.
The structural and administrative omission was not isolated to Chattopadhyay's nomination alone. The Assembly Secretary pointed out that an identical procedural error plagued the party's application to designate Kolkata Municipal Corporation Mayor Firhad Hakim as the Trinamool Chief Whip in the House. Due to these technical and legal deficiencies, Assembly Speaker Biman Banerjee had previously directed the party to submit the official resolution copies as mandated by the rulebook. However, since the opposition block failed to furnish the required paperwork, the formal gazette notification recognizing their status could not be processed.
Addressing the specific findings of Shobhandeb Chattopadhyay's RTI response, Secretary Soumendranath Das reminded all political stakeholders that the Speaker's jurisdiction remains absolute and final within the legislative complex and cannot be legally challenged. Das clarified that while Chattopadhyay was conventionally permitted to perform symbolic and customary rituals reserved for the Leader of the Opposition on the day of the Speaker's election, that initial courtesy does not exempt the party from submitting essential statutory documentation. The final resolution of Chattopadhyay's recognition now rests exclusively on the discretionary judgment of Speaker Biman Banerjee once the technical anomalies are rectified.
